APPEAL - The formal request by an applicant or employer to have a decision, determination, or notice reconsidered by the next higher level of authority.

BACK PAY AWARD - Wages paid for work done prior to separation from employment.

BASE PERIOD - The first four of the last five completed calendar quarters immediately preceding the first day of an individual's benefit year. In a combined-wage claim, the base period must be that of the paying state.

BENEFIT YEAR - The fifty-two week period beginning the first week in which an insured worker first files a request for determination of the worker's insured status and thereafter the fifty-two period beginning the first week in which the individual next files such request after the end of the individuals last preceding benefit year.

BENEFIT YEAR ENDS (BYE) - The ending date of a claim referred to as BYE or benefit year ends. The Saturday date which ends the 52-week period of a claim in which a claimant may receive unemployment benefits, if eligible.

BONUS PAY - Pay from the employer that is in addition to regular pay. It is not necessarily directly related to an individual's production, but more so on that of the unit or entire business. A bonus can be in the form of a Christmas bonus, year-end bonus, early completion bonus, etc. (including many other forms).

BUREAU REVIEW - Bureau means Job Service North Dakota. A part of the appeals process.

BUSINESS INTEREST - Wages earned by an individual who is also considered an owner of the business.

CALENDAR QUARTER - The period of three consecutive calendar months ending March 31, June 30, September 30, and December 31.

CLAIM WEEK - Consists of a period of seven consecutive days beginning at Midnight Sunday and ending 11:59:59 pm the following Saturday night.

COMBINED WAGE CLAIM - A claim established using base period wages from more than one state.

COMMUTER CLAIM - A claim in which an individual who commutes to work from one local office area to another, or crosses state lines to commute to work may also commute to file a claim.

COVERED WAGES - Wages paid to an employee by an employer who is required to pay Unemployment Insurance taxes.

DISCHARGE - To terminate an individual from employment. Discharges may be due to employment misconduct or non-misconduct.

DOUBLE-DIP CLAIM - A second benefit year established without earning 10 times the weekly benefit amount of the second benefit year following the separation from employment within the first claim.

DURATION - A result of comparing the total base period wages to the highest quarter of base period resulting in the total amount of entitlement.

EXCESS EARNINGS - Gross earnings that exceed the weekly benefit amount.

INTERSTATE CLAIM - A claim filed in one state using wages reported in another state. The laws of the state where the wages are reported are used to determine eligibility for benefits; the state where the wages are reported is also considered the liable state.

INTRASTATE CLAIM - A claim filed in the state where the claimant's wages are reported.

ISSUE - A situation or potential situation that prevents an individual from being eligible for benefits. A separation issue involves reasons for leaving employment. A non-separation issue involves non-employer related factors that could prevent the claimant from being immediately ready or able to return to work.

JUDICIAL REVIEW - A review by the courts of a decision rendered at the bureau review level.

LAG QUARTER - The quarter (three consecutive months) prior to the quarter in which the claim was filed.

LIABLE STATE (referred to at times as the Paying State) - The state that actually pays benefits to the claimant as well as the state whose laws determine eligibility.

MAXIMUM BENEFIT AMOUNT - The total dollar amount of benefits the claimant is eligible to receive within the benefit year.

MISCONDUCT - Is conduct evincing a willful or wanton disregard of employer's interests as is found in deliberate violations or disregards of behavior that the employer has the right to expect of an employee.

MONETARY DETERMINATION - A determination of eligibility based on gross insured wages earned by the claimant in the base period. It also reflects the maximum benefit amount, duration, and weekly benefit amount.

MONETARY ELIGIBILITY - Eligibility for Unemployment Insurance benefits based upon the gross insured wages paid to claimant in the base period. The maximum and minimum benefit amounts are determined by law and are subject to change each year.

MOST RECENT EMPLOYER - A provision of the North Dakota Unemployment Compensation Law that requires Job Service to consider separation from earlier employment to determine eligibility if the last employment is of short duration.

NON-MONETARY DETERMINATION - A written determination of eligibility regarding a specific issue or circumstance other than monetary eligibility that may affect benefit eligibility. Items include such things as quitting a job, being discharged, etc. See the definition of an Issue above.

NOTICE OF CLAIM - The notice the employer receives advising that a claim has been filed. The notice also asks the employer for details regarding the separation from employment.

PERSONAL IDENTIFICATION NUMBER (PIN) - A code containing numbers which allow use of the automated phone system and UI ICE to file weekly claims, get instant information on the claim status, and other common claim inquiries.

REEMPLOYMENT PLAN - A written commitment developed by the claimant and claims taker that identifies specific work search or other activities to seek and find employment and reduce dependence upon Unemployment Insurance funds.

RE-OPENED CLAIM - A claim that is a continuation of a claim with a current benefit year, and a remaining balance after a break in filing due to any reason other than intervening covered employment.

SEPARATION - Any termination of employment. It is generally classifiable as a layoff, voluntary quit, or discharge.

SEVERANCE PAY - Payment given to an employee by an employer when the employee is separated from employment.

STANDARD FORM 8 (SF-8) - A form given to federal civilian employees when they are separated from employment, transferred to another payroll, or when they are on leave without pay for seven or more consecutive days.

STANDARD FORM 50 (SF-50) - An official notice of personnel action that separates a federal civilian employee from employment.

TRANSIENT CLAIM - A continued claim filed by a claimant who is traveling and seeking work outside the home area. Also known as a courtesy claim.

UCFE CLAIM - A claim in which some or all of the base period wages have been earned in Federal Civilian Employment.

UCX CLAIM - A claim designed to pay unemployment benefits to those individuals separated from military service for qualifying reasons.

UNEMPLOYED - An individual is "unemployed" with respect to any week during which the individual performs no services and with respect too which no wages are payable to the individual, or with respect to any week during which the individual is substantially unemployed and the wages payable to the individual with respect to this week are less than the weekly benefit amount.

VOLUNTARY QUIT - Termination of employment initiated by the employee.

WAGES - All remuneration for service from whatever source, including commission, bonuses, cash value of all remuneration other than cash, gratuities, and back pay awards.

WEEKLY BENEFIT AMOUNT - The dollar amount a claimant is eligible to receive during a claim week.
