Facing a Layoff or Closure


Job Service North Dakota offices may provide early intervention assistance through Rapid Response when a permanent closure or mass layoff surfaces. The response encompasses the necessary activities to plan and deliver services plus provide access to a variety of other services that enable the transition of dislocated workers to new employment as quickly as possible.


Under the Worker Adjustment and Retraining Notification (WARN) Act, private sector firms with 100 or more full-time employees must provide at least sixty days advance notice in writing for an impending closure or substantial layoff affecting fifty or more workers. The notice goes to the:

  • State Dislocated Worker Office, Job Service North Dakota, PO Box 5507, Bismarck ND 58506-5507;
  • Chief elected official of the unit of local government in which the employment site is located; and
  • Individual workers affected, or their representatives.

Trade Adjustment Assistance (TAA) and Alternative Trade Adjustment Assistance (ATAA) is available for workers who have become unemployed as a result of increased imports from - or shifts in - production to foreign countries. The link www.doleta.gov/tradeact/ accesses TAA/ATAA information and forms for employees or employers to submit Trade petitions to the U.S. Department of Labor.
